1. Acceptance of Terms
Welcome to Letters by Heart. By accessing or using our website, services, or products (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. We reserve the right to update these Terms at any time; your continued use of the Service after changes constitutes acceptance of the revised Terms.
2. Description of the Service
Letters by Heart provides:
- Digital love letters: Create and share personalized digital love letters. A free tier allows letters up to a specified character limit; longer letters and additional features may require a one-time lifetime purchase.
- Digital puzzles: Create interactive puzzles from your own images with personal messages. Digital puzzles can be shared via link.
- Physical puzzles (optional): Order premium physical puzzles (e.g., 1000-piece) made from your custom image, subject to separate checkout and fulfillment terms.
We strive to keep the Service available and secure but do not guarantee uninterrupted or error-free operation.
3. Eligibility
You must be at least 13 years of age to use the Service. If you are under 18, you should have a parent or guardian's permission. By using the Service, you represent that you meet these requirements and that you will use the Service in compliance with all applicable laws.
4. User Content and Ownership
You retain ownership of the content you create—including the text of your love letters, names, messages, and images you upload ("User Content"). By submitting User Content to the Service, you grant Letters by Heart a non-exclusive, royalty-free, worldwide license to store, display, and transmit that content solely to provide, operate, and improve the Service (e.g., showing your letter to someone with the link, hosting your puzzle). We do not claim ownership of your User Content and will not use it for marketing or other commercial purposes unrelated to providing the Service.
You are responsible for ensuring that you have the right to use and share any content you upload (including images for puzzles) and that it does not infringe anyone else's rights.
5. Acceptable Use
You agree to use the Service only for lawful, respectful purposes. You must not:
- Create, store, or share content that is illegal, harmful, threatening, harassing, defamatory, obscene, or that violates any person's privacy or intellectual property rights
- Use the Service to spam, phish, or distribute malware
- Attempt to gain unauthorized access to our systems, other users' accounts, or data
- Reverse-engineer, scrape, or abuse the Service in a way that could harm its availability or security
We may remove content or suspend or terminate access if we reasonably believe you have violated these Terms or applicable law, without prior notice where we deem it necessary.
6. Payments and Refunds
Some features (such as longer love letters or certain puzzle options) may require a one-time payment. Payments are processed by Stripe or other designated payment providers. By making a purchase, you agree to their terms and to provide accurate payment information. All fees are in the currency shown at checkout.
Lifetime access: Where we offer "lifetime" or one-time purchase access, we grant you access for as long as we operate the Service and offer that feature. We do not guarantee that the Service or any specific feature will exist indefinitely.
Refunds: Refund requests are considered on a case-by-case basis. For digital-only purchases (e.g., lifetime letter access), please contact us within a reasonable period if you believe you are entitled to a refund. 7. Intellectual Property (Our Service)
The Service—including its design, branding, software, text, graphics, and other materials (excluding your User Content)—is owned by Letters by Heart or its licensors and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our Service or branding without our prior written permission.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to that policy.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOU USE THE SERVICE AT YOUR OWN RISK.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LETTERS BY HEART AND ITS OPERATORS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL) ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS (USD 100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
11. Indemnification
You agree to indemnify, defend, and hold harmless Letters by Heart and its operators, affiliates, and licensors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms or any law.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause. We will use reasonable efforts to provide advance notice before terminating paid access, except where we reasonably believe you have violated these Terms or applicable law, or where we deem it necessary for the security, safety, or integrity of the Service or other users. We may suspend or terminate without prior notice in those exceptional cases. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive termination.
13. Governing Law and Disputes
These Terms are governed by the laws of the United States and the State in which Letters by Heart operates, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved in the courts of that jurisdiction, to the extent permitted by law. If you are located outside the United States, you may have additional rights under your local law.
14. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may be communicated via the Service or by email where appropriate. Your continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.
